Introduction

Welcome to the SailMates website! This Privacy Policy describes our policies and procedures on the collection, use and disclosure of your information when you use our website. We use your personal data to operate and improve the website and, if you sign up for the First Wave, to send you information about the First Wave, about opportunities to join beta testing and about the launch of SailMates.

Interpretation

Words with an initial capital letter have meanings defined under the following conditions. The following definitions have the same meaning regardless of whether they appear in the singular or plural.

Definitions

For the purposes of this Privacy Policy:

  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to App Bakery s.r.o., the operator of the SailMates website.
  • Cookies are small files that a website places on your computer, mobile device or any other device, containing, among other things, the details of your browsing history on that website.
  • Country refers to: the Slovak Republic.
  • Device means any device that can access the Service, such as a computer, a mobile phone or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable individual.
  • Service refers to the SailMates website, accessible from https://sailmates.co.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company.
  • Usage Data refers to data collected automatically, generated either by the use of the Service or from the Service infrastructure itself.
  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

Information We Collect

When you use the SailMates website, we may collect and process the following types of information:

First Wave form information

Email address – if you voluntarily enter it into the First Wave form.

Usage data

Information about how you use our website. With your consent we use Google Analytics and Microsoft Clarity, through which we may collect data about traffic and interaction with the site, such as clicks, scrolling and movement on the page. We also use Microsoft Clarity to create heatmaps and analyse how user visits unfold.

Device information

Device type, IP address, browser type, operating system and other technical data related to your visit to the website.

Technical and diagnostic data

Information about technical errors and the functioning of the website, which we process through Sentry to ensure stability and fix bugs.

How We Use Your Information and Legal Bases

We use your information to:

First Wave and pre-launch communication

We use your email address to send information about the First Wave, opportunities to join beta testing and the launch of SailMates. Legal basis: your consent (Art. 6(1)(a) GDPR). You can withdraw your consent at any time.

Website improvement

Analysing website usage through Google Analytics and Microsoft Clarity, including heatmaps and analysis of user interaction with the site. Legal basis: consent (Art. 6(1)(a) GDPR), otherwise legitimate interest.

Security and technical operation

Monitoring technical errors, stability and security of the website through Sentry. Legal basis: the controller's legitimate interest in ensuring safe and stable operation of the website (Art. 6(1)(f) GDPR).

We share your information with: service providers (hosting, email, analytics and technical monitoring providers), legal authorities (where required by law).

Data Processing and Third-Party Services

In operating our website we work with several trusted third-party service providers:

Hosting (AWS)

We use Amazon Web Services to host the website.

Analytics

With your consent we use Google Analytics. Analytics cookies load only if you accept them in our cookie banner.

User behaviour analysis (Microsoft Clarity)

With your consent we use Microsoft Clarity to gain a better understanding of how visitors use our website. Clarity lets us analyse interaction with the site through heatmaps and user session recordings, so we can improve its content, design and user experience.

First Wave communication (MailerLite)

If you sign up for the First Wave, we share your email address with MailerLite to send information about the First Wave, beta testing and the launch of SailMates. You can withdraw your consent at any time.

Technical monitoring (Sentry)

We use Sentry to detect technical errors and monitor the stability of the website. The provider of this service is Functional Software, Inc., registered office 45 Fremont Street, 8th Floor, San Francisco, CA 94105, USA. Its authorised representative in the European Union is Sentry Software Netherlands B.V., Schiphol Boulevard 359, 1118 BJ, Amsterdam Schiphol, Netherlands.

Transfers to third countries

Some of our providers (Amazon Web Services, Google, Microsoft, MailerLite, Sentry) may process personal data outside the European Economic Area, particularly in the USA. Such transfers are carried out in accordance with Chapter V GDPR, in particular on the basis of a European Commission adequacy decision including the EU-US Data Privacy Framework, or on the basis of standard contractual clauses, depending on the specific provider. We will provide information about the specific safeguards on request at legal@sailmates.co.

Data Retention

We keep your data only for as long as necessary for the purposes for which it was collected. We keep the email address from the First Wave form until you withdraw your consent, at the latest until the communication related to the First Wave and the launch of SailMates ends. If you do not separately give us consent for further marketing communication, we will remove your email from the mailing list once this purpose ends. We keep the record of your demonstrable consent for at least four years from its withdrawal. Analytics and technical data are kept for as long as needed for analytics, security and technical monitoring purposes, in line with the settings of the individual services used. You can ask us to delete your data at any time at legal@sailmates.co.

Security Measures

To protect your data we implement standard security measures including encryption, secure servers, regular security audits and strict access controls. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

Your Data Protection Rights

You have the right to:

  • Access your personal data and request copies
  • Rectify inaccurate or incomplete data
  • Request erasure of your personal data
  • Receive and transfer your data
  • Object to the processing of certain data
  • Withdraw consent at any time
  • Lodge a complaint with the supervisory authority

We will handle your request without undue delay, at the latest within one month of receipt.

Children's Privacy

Signing up for the First Wave is not intended for users under the age of 18. We do not knowingly collect information from children. If you are a parent or guardian and believe your child has provided us with personal data, please contact us so we can remove it.

Automated Decision-Making and Profiling

The controller does not carry out automated individual decision-making with legal effects within the meaning of Art. 22 GDPR.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by email or a notice on the website and update the "Last updated" date at the top of this Privacy Policy.
